MODALITY FOR INCLUSION OF CASTE NAME IN THE S.C. LIST.

1. The complete proposal with ethnographic support, to modify the existing list of scheduled castes is made by the concerned State Government / Union Territory Administration.

2. The proposal is then referred to the Registrar General of India (RGI), for seeking comments.

3. The proposal once not agreed to by the RGI, is referred back to the concerned State Government / Union Territory Administration, for seeking for further justification of their proposal, in the light of the comments of the RGI.

4. The proposal, if received back from concerned State Government / Union Territory Administration, with further justifications is again referred to the RGI for consideration.

5. If the proposal is not agreed to by the R.G.I, by the second time, the Government of India may consider rejection of the proposal.

6. The proposal agreed to by the RGI, is referred to the National Commission for Scheduled Castes (N.C.S.C), for seeking comments.

7. If the proposal is not agreed to by the (NCSC), it is rejected with the approval of Minister for Social Justice &Empowerment.

8. Such proposals, which have been agreed to by the RGI and the NCSC are processed further and introduced as a Bill for consideration and passing by the Parliament, as required under article 341(2) of the Constitution of India. After the Bill is passed by both the Houses of Parliament an assent of the President is obtained the amendments are notified.

INCLUSION OF PERUVANNAN IN THE SC LIST –TRACK OF MODALITY

(Mannan, Vannan, Perumannan, and Peruvannans are one and the same community in Kerala. They are untouchables. Perumannan and Peruvannans are only reformed forms of Mannan and Vannans. They are synonyms and Mannan Vannan people used these names interchangebly.

1976— The caste names, Mannan, Vannan, and Perumannans were included in the S.C list (Kerala); The most widely used synonym, Peruvannan was not included. It was included in the O.B.C. and O.E.C. lists.

1976 to — :– The community certificate problems as well as the social problems were arised due to the different status allowed for the same community. Complaints were heaped up before the competent authorities. The procedure to allow community certificates was very complicated: Each and every application for community certificates was sent to the Director, SC department Thiruvananthapuram; and to the director, KIRTADS, for their expert opinion and then to the thasildar for decision. Mannan, Vannan people suffered very much from this procedure: and many of them failed to get their deserving certificates in time.

1979–1991:– The community organisations such as K.P.S. requested the state government to solve the problems. As per the directions of the government K.I.R.T.A.D.S made a detailed study on Peruvannan and submitted the same to the SC, ST Development Dept. On 1991, the above department issued the circular No: 13033/E2/90/SC.ST/DD/Dtd27.11.1991.

The circular instructed a complicated procedure to correct the caste name Peruvannan to Mannan, Vannan or Perumannan in the school certificates. Gazette notification also implemented. The problems could not be yet solved successfully.

07/12/1992:-— Mr. K. K. Sankaran vaidyar, the convenor, SC. ST Action Committee, Kottakkal submitted a representation to Sree Panthalam Sudhakaran, Hon’ble Minister, Harijan Welfare.
In his representation, he requested the govt to issue an order stating that the four synonyms, Mannan, Vannan, Peruvannan and Perumannan are included in the Scheduled Caste.

29/01/1993:-— Registrar General India had sent a previous proposal to the Ministry of Social Welfare with favourable recommendation to group Peruvannan with Mannan, Vannan, Perumannan, Velan and Pathiyan in the S.C.List No:37(Kerala) 2002.

1993:-— On studying the report, Ministry of Social Justice and Empowerment sought more details regading the comments: “they(Peruvannan) do not suffer from extreme form of untouchability as in the case of untouchables” in the report submitted by Kerala Government.

1993:-— The Convenor, Sankaran Vaidyar filed an OP:13031/93 B, in the High Court of Kerala, on Peruvannan issue. On 27/09/1993, Justice K. G. Balakrishnan, in his judgment, directed that suitable recommendation may be made by the state government to redress this grievance.

28/07/1995:-— The convenor, Sankaran Vaidyar, on the support of the above judgment, submitted a representation to Sree A. K. Antony, Chief Minister, Kerala and repeated his above request again.

14/08/1996:-— The convenor, Sankaran vaidyar submitted a representation to Sree E. K. Nayanar, the Hon’ble Chief Minister of Kerala to take necessary steps to solve Peruvannan issue as per the direction of the Kerala Hgh Court.

1997:-— The convenor, Sankaran Vydiar, filed an O P again in Kerala High Court No:3750/1997. He requested to declare Peruvannan, Mannan, Vannan, and Perumannan are one and the same caste.

12/12/2000; 10/09/2001; 25/11/2001; 01/04/2001; 17/05/2002:-— Ministry of Social Justice and Empowerment sent 5 D.O. Letters to Kerala Government and requested to submit more details called for on 29/01/1993. But the state government failed to submit the called for reply to the Central Government.

2004:-— The judgment of the Honourable Justice K. S. Radhakrishnan in the O.P No:2004(3)KLT967 (Smt, Madhavi vs Scrutiny Committee case) made a turning point in Peruvannan issue. The community certificate problems increased.

2004:-— Mannan Vannan Smudaya Sangham was organised and registered and took up Peruvannan issue as the main problem to be solved.

21/02/2007:-— M.V.S.S leaders; Advocate M. Raghuthaman, N. Asokan Master and K. Venugopal went to New Delhi and submitted representation to the Honourable Minister, Meera Kumar, Ministry of Social Justice and Environment, through the Honourable Ministers, A.K.Antony, Vayalar Ravi, E.Ahammed; and M.Ps Abdul Vahab, and Kurian. The request was to include Peruvannan in the S.C list.
We got the information from the Director, Malhothra, Sasthry Bhavan that they were dealing  with a file on the same issue. He added that one Sankaran vydiar was the applicant.

2007:-— M.V.S.S made contact with Kottakkal Sankaran Vydiar, and discussed Peruvannan issue, his O.P in the High Court, and his service in the field. He entrusted all the files, including O.P to M.V.S.S.

2007:-— M.V.S.S made contact with Advocate Chandra Sekharan, Ernakulam, who was dealing with the above O.P and made arrangement to continue the case.
M.V.S.S, under R.T.I collected the information about the position of the Peruvannan file in the Ministry of Social Justice and Empowerment. It is realised that the matter was under hybernation in Kerala Secretariat. The matter was brought under the notice of the High Court.

03/01/2008:-— Hon’ble justice H. L. Dattu and K. M Joseph in their judgement in O. P. No: 3750/97.U submitted that KIRTADS would be in a position to submit the enquiry report on Peruvannan within a period of three months. Up on the receipt of the report of KIRTADS, the state government would be taken appropriate action in the matter.

2008:-— MVSS submitted request to the Honourable Minister, A. K. Balan, SC. ST Dev dept to take necessary steps to obtain the further report from KIRTADS.

20/06/2008:-— KIRTADS submitted further details called for on Peruvannan to the State Govt.

-/07/2008:-— MVSS made enquiry of the position of the report sent by KIRTADS. The SC ST Dev Dept informed that the said report has not been received there.

-/08/2008:-— MVSS made KIRTADS sent another copy to the above Dept again.

12/10/2008:-— Sree Pallippuram Balan MLA, made submission in Kerala Assembly about the delay made by the State Govt in submitting the report on Peruvannan to the Central Govt.

05/11/2008:-— MVSS requested the Principal Secretary SC ST Dev Dept to submit the report called for to the Central Govt with out further delay.

07/12/2008:-— MVSS made request to Sree Oommen Chandy, and MLA Aryadan Mohammed to intervene in the matter and do needful  to avoid delay on the part of the State Govt. Both of them requested the minister, A. K. Balan to expedite the matter.

22/05/2009:-— However the state govt submitted the called for report on Peruvannan to the Central Govt.

24/05/2010:– On request under RTI Act, the Ministry of Social Justice and Empowerment informed MVSS that the report sent to have submitted by the State Govt has not been received there in the Central Ministry’s office.

12/07/2010:-— MVSS informed the State Govt that the details, said to have sent to the Central Govt on 22/05/2009 has not been received there in the Ministry’s Office; and also requested to the Principal Secretary to send another copy with out further delay.

08/09/2010:-— The State Govt sent another copy of the report dated 22/05/2009 to the Director, (SCD) RLCell; New Delhi.

23/03/2011:-— The Director, Malhothra, Shastri Bhavan, New Delhi informed MVSS under RTI Act that the report submitted by Kerala Govt has been received in their office.

15/09/2011:-— The Office of the R.G.I informed MVSS that their office is examining the proposal and preparing comments for the Nodal Ministry and the same can not be shared with any third party.

03/05/2012:-— Under RTI, the Senior Research Officer informed that the proposal is under process.

2012:-— The R.G.I Research Wing sent the proposal with their comments to the National Commission, (SC) New Delhi.

2012:-— National Commission for SC, New Delhi wanted the enquiry report in respect of Peuvannan, from the National Commission (SC) Kerala.

30/01/2013:-— National Commission for SC, State Office, Kerala submitted the called for report to the National Commission for SC, New Delhi.

2013:-— National Commission for SC, New Delhi, further wanted the report from SC ST Commission, Kerala.

2013:-— SC ST Commission Kerala made sitting in Kannur, Badagara, and Palakkad and sought openion of Mannan Vannan people about the inclusion of Peruvannan in the SC List; and collected other related matters.

28/10/2013:-— MVSS submitted a detailed account of Peruvannan with a good number of necessary documental evidences.

– /11/2013:-— Two organisations: Organisation for Genuine SC ST’s in the State of Kerala and SC ST Vidhyabhyasa Vikasana Samithi submitted representation, to the Commission objecting the incusion of Peruvannan in the SC List.

2013:-— SC ST Commission kept pending the submission of the report called for to the National Commission for SC New Delhi for mere reason of the above representation.

2013:-— MVSS obtained the copy of the above representation and made a thorough study of the same, and requested the Commission to give a chance to counter it.

2013:-— The commission agreed and given two dates in successive weeks; but sorry to note that on both days we appeared, summarily denied the chance to counter. However, MVSS submitted the counter points in black and white with necessary exhibits to prove.

27/10/2014:-— MVSS submitted a detailed account of peruvannan to the National Commission for SC New Delhi; with necessary enclosures to prove.

27/10/2014:-— MVSS submitted a humble request to the Honourable Minister, Ministry of Social Justice and Empowerment to take necessary steps to expedite the matter.

2016:-— News appeared on the TV screen that, the decision of the central government ministry to introduce the Bill (inclusion of Peruvannan in the SC List).

2016:— The bill has been passed in both Lok Sabha and Rajya Sabha.

    എന്റെ പേര് ശ്രീരാഗ് കെ പി. ഞാൻ പെരുവണ്ണാൻ (peruvannan) സമുദായത്തിൽ പെട്ട ആളാണ് Government order പ്രകാരം (G.O 637250/G1/2016 SCSTOD DATE:27/06/2016) SC യിലേക്ക് ആവുകയും ചെയ്തു. ഞാൻ രണ്ടാം വർഷ BTECH വിദ്യാർത്ഥിയാണ്.എന്നാൽ online ആയി Egrant ന് അപേക്ഷിക്കുമ്പോൾ എന്റെ ജാതി SC യിലോ മറ്റു catagary യിലൊ കാണിക്കുന്നില്ല അതുകൊണ്ട് Egrant ചെയ്യാൻ കഴിയുന്നില്ല .

    • കേന്ദ്രസര്‍ക്കാര്‍ പെരുവണ്ണാനെ പട്ടികജാതിയില്‍ ചേര്‍ത്തെങ്കിലും, കേരള സര്‍ക്കാര്‍ അതു് അംഗീകരിച്ചു കെ എസ് & എസ് എസ് ആര്‍ ഭേദഗതി ചെയ്തു് കേരള ഗസറ്റിലും കേരള പി എസ് സി ലിസ്റ്റിലും ചേര്‍ക്കുന്നതിനാവശ്യമായ നടപടികള്‍ നാളിതുവരെ സ്വീകരിച്ചിട്ടില്ല. അതു കൊണ്ടു് വിദ്യാര്‍ത്ഥികള്‍ക്കു വേണ്ടുന്ന ആനുകൂല്യങ്ങള്‍ ലഭിക്കാന്‍ ഇപ്പോഴും പ്രയാസമുണ്ടു്.
